LAW OF THE REPUBLIC OF KAZAKHSTAN
"CONCERNING THE REPUBLIC'S BUDGET FOR YEAR 2002"

Article 1. The Republic's Budget for Year 2002 shall be approved in accordance with Supplement 1 as follows:

revenues 460612614 thousand Tenge;

received official transfers (grants) 49064505 thousand Tenge;

repayment of principal debt on loans previously issued from the Budget 10727276 thousand Tenge;

expenditures 567856905 thousand Tenge;

crediting 33024491 thousand Tenge;

deficit 80477000 thousand Tenge or 2.3 per cent of the predicted volume of the gross domestic product of the country.

The Government of the Republic of Kazakhstan shall provide for financing of the deficit of the Republic's Budget in accordance with the legislation of the Republic of Kazakhstan.

Article 2. Lease payments for use by the Russian Federation of the military test sites in amount 4251500 thousand Tenge shall be shown in the revenues of the Republic's Budget, of which:

494720 thousand Tenge shall be received in a monetary form;

3756780 thousand Tenge shall be received on a compensatory basis in the form of supplies of arms and military machinery, rendering of services associated with their repair and training of military servicemen in military educational establishments of the Russian Federation as well as other supplies and services, in accordance with Article 17 of the Agreement Between the Republic of Kazakhstan and Russian Federation on military cooperation dated 28th March 1994 and used by the Ministry of Defence of the Republic of Kazakhstan with registration of expenditures under the Republic's Budgetary Programme "The Implementation of Interstate Agreements on Leasing of Military Test Sites".

Amount of 17779000 thousand Tenge shall be specified in the Republic's Budget for Year 2002 as receipts of lease payments for use of the Baikonyr Centre.

Article 3. It shall be established that in Year 2002 the share of the Republic of Kazakhstan under production sharing, which is received under Production Sharing Contracts shall be included into the Republic's Budget in amount of 100 per cent, except for the West Kazakhstan Province, where 90 per cent shall be included into the Republic's Budget and 10 per cent into the local budget.

Article 4. The subsurface users who previously made payments to the Republic's Fund for the Protection and Recovery of the Mineral and Raw-Material Base on the basis of the Decree No. 135 of 24th February 1998 of the Government of the Republic of Kazakhstan "Concerning the Measures for Facilitating the Transition of the Work Of Subsurface Users on Contractual Bases" prior to the conclusion of subsurface use contracts, shall make said payments in favour of the Republic's Budget under the "Royalties" code of the Uniform Budget Classification.
