Edict No. 853 of 26th april 2002 of the President of the Republic of
Kazakhstan "Concerning the formation of the "Aktau seaport" special
economic zone"

In accordance with the Law of 26th January 1996 of the Republic of Kazakhstan "Concerning Special Economic Zones in the Republic of Kazakhstan" I decree:

1. That the "Aktau Seaport" special economic zone shall be formed for the period until 1st January 2007.

2. That the attached Regulations Concerning the "Aktau Seaport" Special Economic Zone shall be approved.

3. That this Edict shall enter into force from the 1st January 2003.

Regulations Concerning the "Aktau Seaport" Special Economic Zone

1. General Provisions

1. The "Aktau Seaport" special economic zone (henceforth SYMBOL 151 \f "Times New Roman" \s 12 SEZ) shall be situated in the territory of the merchant marine port and the territory adjacent to it within the boundaries of the administrative territorial boundaries of the city of Aktau in the Mangystau Province, in accordance with the boundaries shown on the attached survey.

The territory of the SEZ shall be 227.1 hectare and it shall be an inseparable part of the territory of the Republic of Kazakhstan.

2. The "Aktau Seaport" special economic zone shall be formed for the purposes of speedy development of the region for activation of the Republic's integration into the system of world economic relations, formation high efficiency, including high-technology and export-oriented production facilities, production of new types of goods, attraction of investments, adoption of legal standards of market relations, introduction of advanced methods of management and business, as well as solving of social problems.

Banking services in the territory of the SEZ shall be rendered by second-tier banks in accordance with the banking legislation of the Republic of Kazakhstan.

3. Activities of the SEZ shall be regulated by the Constitution of the Republic of Kazakhstan, Law of 26th January 1996 of the Republic of Kazakhstan "Concerning Special Economic Zones in the Republic of Kazakhstan", as well as other legislation of the Republic of Kazakhstan.

Where an international treaty ratified by the Republic of Kazakhstan establishes other rules than those which are contained in legislation concerning special economic zones, then the rules of the international agreement shall apply.

4. The SEZ shall represent a restricted territory of the Republic of Kazakhstan on which a special legal regime shall be in effect.

5. The Akimat of the City of Aktau shall:

carry out management of the SEZ;

carry out elaboration and implementation of the strategy and programme for development of the SEZ;
