The Government of the Republic of Kazakhstan and the Government of the United States of America, (hereinafter referred to as "the Parties"), Taking into account the strategic character of relations between the Republic of Kazakhstan and the United States of America; expressing willingness for close interaction in Operation Enduring Freedom regarding the struggle against international terrorism, religious and political extremism at the bilateral level; Reaffirming the terms of the Democratic Partnership Charter between the Republic of Kazakhstan and the United States of America of February 14, 1994, the Kazakhstani-American Joint Statement on Terrorism of November 3, 1998, and the Memorandum of Mutual Understanding on Overflight of United States Military Aircraft Supporting Operation Enduring Freedom of December 16, 2001; Recognizing the application of the Agreement among the State Parties to the North Atlantic Treaty and the other States Participating in the Partnership for Peace regarding the Status of their Forces done at Brussels on June 19, 1995 (PfP SOFA) to U.S. personnel participating in activities under this Memorandum; Referring to the bilateral agreements reached earlier on military cooperation and intending to reinforce these; Have reached mutual understanding on the following: I. With reference to the request of the United States Government to the Government of the Republic of Kazakhstan to designate Almaty International Airport (further referred to as the Airport) as a divert airfield for U.S. military aircraft operating from Manas, Kyrgyzstan in support of Operation Enduring Freedom, Government of the Republic of Kazakhstan agrees to the designation of the Airport as a divert airfield with the following conditions: 1. U.S. aircraft may divert to the Airport only in cases of inflight emergencies impairing safety of flight and requiring immediate landing of the aircraft, weather conditions below the minimum required for landing at Manas, or emergency closure of the Manas runways. Government of the Republic of Kazakhstan has the right to deny use of the Airport as a divert airfield if weather conditions are below the minimum required level for landing at the Airport, there is an emergency closure of the Airport runway, there is a YIP aircraft landing at the Airport or taking off from the Airport (excluding cases when landing is requested by an aircraft in an emergency situation). All U.S. aircraft that divert to the Airport will launch from the Airport upon elimination of reasons for divert. 2. There shall be no basing of U.S. aircraft at the Airport. 3.
