Concerning the Draft Law of the Republic of Kazakhstan «Concerning the introduction of additions to certain legislative acts of the Republic of Kazakhstan concerning issues of subsurface use and conducting petroleum operations in the Republic of Kazakhstan»

            The Government of the Republic of Kazakhstan decrees:

            that the draft Law of the Republic of Kazakhstan «Concerning the Introduction of Amendments and Additions to Certain Legislative Acts of the Republic of Kazakhstan Concerning Issues of Subsurface Use and Performance of Petroleum Operations in the Republic of Kazakhstan» shall be submitted to the Mazhilis of the Parliament of the Republic of Kazakhstan for its consideration.

Draft Law of the Republic of Kazakhstan

Concerning the introduction of amendments and additions to certain legislative acts of the Republic of Kazakhstan concerning issues of subsurface use and performance of petroleum operations in the Republic of Kazakhstan

Article 1.  The following amendments and additions shall be introduced to the following legislative acts of the Republic of Kazakhstan:

1.  To the Law of 28th June 1995 of the Republic of Kazakhstan «Concerning Petroleum» ():

1)  subparagraph 13) of Article shall be replaced with the following:

«13)  maritime scientific research scientific research operations associated with the performance of petroleum operations off-shore and studies in their consequences;»;

2)  in Article 35:

paragraph 1 shall be replaced with the following:

«1.  The Republic of Kazakhstan shall have the priority right to purchase petroleum from contractors at prices not exceeding world market prices.  The maximum quantity of the petroleum to be purchased, the procedure for determining prices and type of payment shall be specified in a separate agreement with a contractor.»;

paragraph 2 shall be excluded.

2.  To the Law of 27th January 1996 of the Republic of Kazakhstan «Concerning Subsurface and Its Use» ():

1)  the first clause of subparagraph 15) of Article 1 shall be replaced with the following:

«15)  Kazakhstan content percentage contents of annual quantities:»;

2)  subparagraphs 6), 12) of Article 7 shall be replaced with the following:

«6)  determines the procedure for granting subsurface use rights;

12)  approve the procedure for the maintenance of the register of goods, work and services produced in the Republic of Kazakhstan, which may be used when conducting subsurface use transactions or for incidental activities relating to a contract;»;
