between the Government of the Republic of Kazakhstan and the
Government of the Slovak Republic on war graves
(Astana on 30 March 2010)

the Government of the Republic of Kazakhstan and the Government of the Slovak Republic,

hereinafter referred to as «Parties»

guided by desire to develop and enhance the cooperation through further development of bilateral contacts and strengthening the mutual comprehension,

basing on necessity to secure the right of eternal repose of military personnel and civil persons who died in the course of combat operations during the First or the Second World War, in captivity or died as a result of their consequence, including in postwar period,

in accordance with the generally recognized principles and norms of the international humanitarian law, and in particular with provisions of the Geneva Conventions of 12 August 1949 relating to the Protection of Victims of International Armed Conflicts and their Additional Protocols of 8 June 1977,

have agreed as follows:

Article 1

Definitions

Terms used in this Agreement shall mean the following:

1. «Kazakhstan war victims»:

1) persons who were of Kazakhstan origin, were born or lived in the territory of the present Republic of Kazakhstan and were the members of the armed forces of the Russian Empire or the members of the armed forces of the Union of the Soviet Socialist Republics, who died during the First or the Second World War or as a consequence of those events and were buried in the territory of the present Slovak Republic;

2) prisoners of war or civil persons who were of Kazakhstan origin or were born or lived in the territory of the present Republic of Kazakhstan, who died during the First or the Second World War or as a consequence of those events and were buried in the territory of the present Slovak Republic.

2. «Slovak war victims»:

1) persons that were members of the Austria-Hungary armed forces who were citizens of Austria-Hungary with a permanent residence in the territory of the present Slovak Republic, who died during the First World War or as a consequence of this event and were buried in the territory of the present Republic of Kazakhstan;

2) persons that were members of the Czechoslovak Republic armed forces who were citizens of the Czechoslovak Republic with a permanent residence in the territory of the present Slovak Republic and persons that were members of the Slovak State or the Slovak Republic armed forces who were citizens of the Slovak State or the Slovak Republic with a permanent residence in the territory of the present Slovak Republic, who died during the Second World War or as a consequence of this event and were buried in the territory of the present Republic of Kazakhstan;
