                              REGULATION
                        on a tender commission

            (Edited Decree of the State Procurement Agency

                        I. General provisions

     1. The present Regulation is developed in compliance with Article
 15 of the Law of the Kyrgyz Republic «On Public Procurement of  Goods,
 Works  and  Services» which determines the procedure of establishment,
 functions  and  rules  of  the  Tender  Commission  of   a   procuring
 organizations when carrying out public procurements (goods,  works and
 services) financed at the expense of public resources.
     2. The  Tender Commission of the procuring organization is one of
 the major participants of procurement procedures.
     3. In  its  activities  the  Tender  Commission  of the procuring
 organization shall be guided by normative and legal acts of the Kyrgyz
 Republic, as well as by the present Regulation.
     4. The procurement organization,  in a compulsory  manner,  shall
 establish a Tender Commission for procuring goods,  works and services
 at the expense of  public  resources.  The  personnel  of  the  Tender
 Commission of the procuring organizations,  when being established and
 changed,  shall be agreed with  the  State  Procurement  Agency  in  a
 compulsory manner.
     Public resources are:
     - state    budget    resources,   budget   resources   of   local
 selfgovernment bodies directed at implementation of its won activities
 and capital investments;
     - extra-budgetary resources of procuring organizations;
     - resources  extended  as  foreign assistance under international
 agreements,  if other methods of their use are not  envisaged  by  the
 agreements;
     - guaranteed and secured credit resources.
     5. When  conducting  procurements  the  Tender  Commission of the
 procuring organization may include representatives of other state  and
 public organizations, who shall be officially invited by the procuring
 organization,  having specified the types of goods, works and services
 to be procured.
     6. The Tender Commission of the procuring organization shall  not
 be a contracting party.
