The Law of the Republic of Kazakhstan On Labour in the Republic
of Kazakhstan dated December 10, 1999, № 493-1

Present Law adjusts public relations, arising in process of citizens constitutional right realizations in freedom of labour in the Republic of Kazakhstan.

Chapter 1. General provisions

Article 1. Basic concepts, used in the Present Law

The following concepts are used in the Present Law:

Work - human activity directed on creation of material, spiritual and other values, necessary for people life;

Labour relations - relations, arising between Employer and Employee concerning realization of certain work activity by Parties, as a rule, under Personal Labour and Collective Contracts;

Employer acts - acts (orders, decisions, instructions, rule of internal labour schedule), issued by Employer (Employer's representative);

Personal Labour Contract - bilateral agreement between Employee and Employer concluded in writing form, under which Employee undertakes to execute work on certain speciality, qualification or post with execution Employer's acts, and Employer undertakes to pay in time and in complete volume to Employee salary and others money payments, stipulated by legislation and parties agreement, to provide working conditions stipulated by labour legislation and Collective Contract;

Harmful (especially harmful) working condition - working condition, at which influence of the certain production factors results to reduction of Employee's serviceability either disease or negative influence to his posterity health;

Dangerous (especially dangerous) working condition - working condition, at which influence of the certain production factors results to sudden sharp deterioration of health either trauma of Employee or his death in case of work protection rules non-observance;

Heavy physical works - kinds of Employee activity connected with weights manually rising or moving or other works with charge of energy more than 300 kcal/hour;

Time for rest - time, during which Employee is free from labour duties execution and which he can spend at own discretion;

Salary - compensation (income) for work according to its complexity, quantity and quality; reflecting complexity of works, carried out by him; Qualifying Category - Employee's level of skill;

Collective Contract - legal act, which has been made out as written contract, signed by one or several Employers (their representatives) and one either several trade unions or Employees, not being members of trade union, which has formed their organization for negotiations;

Business trip - Employee's direction under the Employer order for execution of labour duties outside of constant work place;

Indemnifications - money payments connected with work regime and working conditions, with compensation of expenses to Employees suffered by them at works execution;
